SOVEREIGN DEFULT

Mark these words: Sovereign Default

Not many people are exposed to these words (ummm…. ok, me at least). But this will be the catch phrase for 2010. Forget ‘sub-prime’. The new lingo is sovereign default. And this 2 big words will bring the entire world down to it’s knees.

I am a believer that there will be a double dip in the world recession simply because I do not believe that the current pump priming of economies globally is going to be able to pull us out of the on-going financial crisis. Apparently the world economy is on some kind of a rebound now. Green shoots sprouting everywhere. Is it? Personally I don’t think so.

The Dubai fiasco had started the double dip. US$50 to $60 billion may seem like chicken feet compared to what the US government had to deal with (read: hundreds of billions). But is the Dubai case isolated? That will be the most important question.

What are the unfolding effects? For starters, we are now being told that a large portion of the Dubai debts is owned by British banks. The Brits are at the end of their wits and this will not go down well with their already very ill economy. And if the Brits get kicked, the Frenchies will get their knickers twisted. And the Germans then hammered. You get what I mean.

And amidst all this, a new form of disaster has emerged. Sovereign debt. The Greeks are, pardon my language; in deep shit. Sort of knee high. So that’s quite a lot of shit. Their government is unable to repay their bonds. Sovereign bonds are government bonds which are issued and denominated in foreign currency.. So upon maturity, the issuing government will have to repay the bond holders in the denominated foreign currency. If the said government is unable to purchase the said foreign currency for repayment of debt, they are screwed.

And this is what we are facing now. We in Malaysia are not getting a lot of coverage on this, yet. Just like the beginning of the sub-prime crisis in the States. We are after all frogs living under coconut shells.

Your next question will be: Greece? So what? Not that big economy aren’t they? And it is such questions which show the naivety of Malaysians. It is only in Malaysia where we ‘live on our very own island’. Everyone else in the world live dependently upon one another.

The Greeks’ default will pull with them their business partners and the European Union. Portugal  and Spain are already on the radar right now .. Their credit default risk has just reached the ceiling. Not very good signs if you ask me. So, who else are going down? One by one, other related nations will get pulled down together – and drown.

What is causing this mayhem? Budget deficit. Government pump priming their nation out of the credit crisis started by Wall Street. A budget deficit means that the nation budgeted expenditure exceeds its income. In our lay man term, spending in excess of your means. When we need to spend more than our paycheck, we have the credit card(s). For governments, they issue bonds. Get the dough now, pay in the future. The Greeks and Portuguese are in their ‘future’ now, and they don’t have money to pay. So, that’s the basics of it – at least from my understanding.

So, if this default disease proves more lethal than AH1N1, guess where the virus is going to spread to? Everywhere. Including the Americans who are borrowing money from their descendants of 2098. Will this spark another round of major credit crisis when the 1st of 2 years ago is still not solved yet. The likely answer is a yes. And this time there will be no more trillion dollars printed to rescue the Americans. Not that their money printing machine is broken, they simply do not have the means to do it anymore. So, come the double dip, the Americans will perish. Millions of Americans will be living on streets or huddling up under flyovers.

And the same shit is going to hit Malaysia this time. There is not going to be any money for Najib to spend his way out this time around. PNB can’t even sell a quarter of its recent RM10 billion bond. The country is already as dry as a salted fish.

And rumours have it that Singapore is high on the potential sovereign default list. Their budget deficit is also crazy ass high. This is very worrying. Everytime Singapore sneezes, we shit in our pants. We do trade with them, like, a lot. Really really a lot. Back in the Asian Financial Crisis of 1997, Thailand brought the entire South East Asia down with it. And we aren’t even that economically active with them as compared to Singapore. And to make matters worse, Singapore is a mini US. Only geographically distanced. If the Americans die, the Singaporeans die. If the Singaporeans die, we die!

So folks, pray that the world does not end on 10 December 2012. Pray Nibiru comes quicker, much quicker. At least we don’t have to see Najib and gang make life a living hell for us ordinary Malaysians in the coming very desperate times. Plus we know they are not smart enough to prepare Malaysia for rainy days.

The world is crumbling and all Malaysia is concerned of is who buggered whom.

MEDIOCRE JUDICIAL CHARACTER MAKES NONSENSE OF JUSTICE

Anwar Ibrahim’s sodomy II sequel has all the trappings of a selective political prosecution. The case involves a sequence of allegations made by his political aide Mohd Saiful which is riddled with some form of hidden and invisible plot which has to be brought out into the open.

No doubt any prosecution would involve some form of a story or a play. There is bound to be some form of human conflict which would run contrary to the law of the land. Hence after a report is made and the investigations are carried out and if there is prima facie evidence the Attorney General (AG) would prefer the charge or charges.

In Anwar’s sodomy II the charge is under section 377B of the Penal Code which reads:

“That you on June 26, 2008…….intentionally had carnal intercourse against the order of nature with Mohd Saiful Bukhari Azlan where you inserted your penis into his anus, and therefore you had committed a crime which can be punishable under section 377B of the Penal Code.”

Now every sane and right thinking person should first and foremost take note that the operative words of the charge are “WHERE YOU INSERTED YOUR PENIS INTO HIS ANUS” and in a criminal case the duty of the prosecution is to prove beyond reasonable doubt in establishing the charge that Anwar did in fact “insert his penis” into the anus.

We are all very familiar that when a report is made in a case of sexual assault or rape, the first thing the police would do is to send the victim to a government hospital to be examined and if it is established by medical evidence that there was indeed a case of sexual assault or penetration, then the aggressor is apprehended and after investigations are carried out, the AG may decide to prefer charges. If it was consensual no charges are preferred.

However in Anwar’s case Saiful claims he was sodomised on June 26, 2008 but he consented to it. He did not pass motion for two days. He went to see Najib and informed him of what happened. He was advised to go to a hospital which he did. He went to two private hospitals before he was referred to a government hospital at which point he lodged the police report.

Anuar had applied to quash the charges on the grounds that it was mala fides, oppressive, and an abuse of the process of the court as it is a conspiracy and is malicious on the basis that a medical report has suggested that there was no penetration.

The High Court Judge dismissed the application. Anwar appealed to the Court of appeal and it is beyond our comprehension as to how the Appeal Court could deliver a unanimous decision on the reasoning that they concur with the submission of the lead prosecutor that the medical report was not conclusive evidence.

So what has happened to the “BEST EVIDENCE RULE” in Malaysia?  Is this rule of evidence dead as with the rule of democracy?

But the lead prosecutor has submitted that he will not rely on the medical report (the best evidence) but the case would be based on the testimonies of witnesses (who would that be when it was only Anwar and Saiful if at all it actually happened) including forensic (manufactured) evidence.

So herein is the answer. The best evidence rule goes out of the window. In its place will be introduced MANUFACTURED EVIDENCE to establish the charge even thought there was no penetration.

Let’s go a little further. Anwar filed an application to disqualify the High Court Judge from continuing to hear his case on grounds of the allegation of bias and lying over his failure to take appropriate action against the Utusan Malaysia’s coverage of the trial The news paper is owned by the United Malay National Organisation (UMNO).

The judge miserably failed in the Oath and Affirmation that he took when he accepted his appointment of office. The Oath states that: “I will faithfully discharge my judicial duties in that office to the best of my ability, that I will bear true faith and allegiance to Malaysia, and will preserve, protect and defend its Constitution.”

In the context of the Oath the judge had taken to defend the “Constitution” and since Anwar is claiming that he is being deprived of his “personal liberty” the Judge should have stepped down and let the application to disqualify him be heard by another judge.

This he failed to do.  He totally ignored all the well established judicial precedence on the rule of bias. He decided to become the judge, jury and the executioner of the application made to disqualify him. It is apparent that he lost sight of the wisdom and the integrity of his office. He committed a grievous mistake by hearing and disposing of the application by himself.

The conclusions that he drew defeats commonsense and was totally illogical for a person who has been appointed to that high office when he said, “The allegations that I lied in arriving to the decision ( not to take action against Utusan) is incorrect. After looking at the testimony by the witness, and the affidavit of the application, there is no truth to such allegation. I am certain that any right rational people would not see the decision as biasness on my part.” (reported by Malaysiakini)

Why is it so?

There are a few factors that have to be considered.  There is a time honoured legal Maxim that states: “ No one should be a Judge in his own cause.”

Apart from the time honoured Maxin the judge had as a person to determine an issue which is made against him would naturally be prejudiced and being only human would never be able to arrive at a decision with certainty that would be acceptable to the applicant when all the right thinking people conclude that he is biased.

Further the judge failed to realize that the human consciousness is unique as it is a matter of perception and in this case it would be all the more unique as the application was against the judge to disqualify him from continuing to hear the case.

And that is why in (490-420 B. C.) Protagoras saw the full implications of what we are discussing today that took place in Anwar’s case. It led Protagoras to ask these questions.

“If other people believe in different things to you, how do you know that your beliefs are right? How do you know that anyone’s beliefs are right?

Therefore, with the facts that are before all right thinking people not only in Malaysia but also from all over the world, we are certain that in applying inductive logic to the prevailing facts we will reach the same conclusion that the prosecution of Anwar is politically motivated.

Najib, it is high time that you stop pretending that you can continue living in a diabolically conceived comfort zone. The whole world cannot be wrong and you are right.

May we leave you to ponder on a Latin Legal Maxim: “Nemo ex alterius facto praegravari debet” which means, No one ought to be burdened in consequence of another’s act.

REBELS WITHOUT A CAUSE

As each day limps by the United Malay National Organisation (UMNO) and its ever decreasing membership are becoming more interesting to observe. From a monolithic unity which lasted for some 32 years it now by and large faces an overlapping power struggle within it membership.

This has given rise to each aspiring leader within UMNO to seek out every opportunity and capitalize on it and turn such situation into a monologue with the small segment of followers who are monomaniacs.

These small bands of radicals are so obsessed and live with a dysfunctional brain that they believe Malay Supremacy rules the world order. They will never realize that the people of this nation in the first instance who have a diversified out look of the art of politics compartmentalize UMNO’s leaders as megalomanias and their followers as sycophants.

The UMNO Membership to a large extent currently consists of morons who survive as rent seekers. They have no strength of character and are incapable of earning a living through dignified means. Thus they have no integrity.

They are now rebels without a cause where they are given the blanket approval by the Royal Malaysian Police Force to demonstrate as and when they so desire.

This morning some 300 hooligans  were led by their nose by non-other than the UMNO youth leader Khairy carrying banners and yelling “mind, mind, mind your own business” and had a rally before the Australian High Commission at Kuala Lumpur.

One wonders as to how such a noisy bunch of fools whose appearance was more akin to some form of lunatics who had amass broken out from some mental asylum were given the freedom to perform such dubious acts with solidarity and were not a threat to the security of other peace loving people of this nation.

The cause for the boisterous rally was owing to a letter sent by some 40 Members of Parliament from Australia to the Malaysia’s High Commissioner in Australia expressing their view on the way Anwar is being prosecuted on the Sodomy II sequel currently being shown to the world at large. The letter is reproduced for your ease of reference.

Dear High Commissioner,

We write to you with regards to the trial of Anwar Ibrahim which is currently taking place in Kuala Lumpur.

We members of the Australian parliament believe Malaysia is an important country, an emerging power in our region, and a friend of Australia. However the trial of Anwar Ibrahim raises serious concerns for us.

While Australia and many other countries no longer have laws against sodomy we respect the right of Malaysia to determine what should be its laws relating to personal morality.

Of more serious concern however is the fact that this trial is taking place at all, particularly given the testimony of Munawar A. Anees in the Wall Street Journal (see attached). We understand that the US State Department has urged Malaysian authorities to resolve this matter in a manner that builds confidence in the impartial rule of law in Malaysia, and we agree with this sentiment. Many friendly observers of Malaysia find it difficult to believe that a leading opposition voice could be charged with sodomy a second time, and so soon after his party made major gains in national elections. It should be made known to the Malaysian Government, that in our opinion, global esteem for Malaysia will be affected by these charges against Mr Anwar.  We hope that Malaysia’s authorities will not pursue these charges.

Now that you have had the benefit of the doubt of reading the letter you can form an informed opinion on the letter.

As far as any right thinking person is concerned they will conclude that the letter is basically addressing the issues which we Malaysians have been discussing for over a year and how Najib’s government is purporting to silence Anwar in his political advancement in our nation and against UMNO’s hegemony.

When some brave souls carried out a passive resistance last year on the “Death of Democracy” by wearing black shirts or had candle light vigils they were manhandled by the police thugs and even the lawyers who were there to represent their clients were taken into remand.

Some thing seems to be awfully wrong within our government. Now it appears that the Prime Minister is giving orders to his band of thugs to create disorder with the hope that it will give him and his sinking ship the opportunity to act in haste in the name of “National Security.”

Don’t worry Najib we can tolerate your nonsense and wait to exercise our rights at the ballot box. In the meantime we will forgive you and your thugs for you know not what you are doing.

As for Khairy Jamaluddin, you are indeed in insult of an export from one of the oldest Institution of higher learning. We wonder how on earth you ever managed with this type of mediocre mentality to get admitted into that fine old Institution.

You are an insult to the word “intellectual” as you clearly demonstrate the fact that you are not able to comprehend a simple and politely written letter in English.

IMAGINED THREAT OF A NON EXISTENT RACE

The daily life of an average middle class Malaysian is filled to the brim with nothing but racial controversies. The nation is the home of a diverse group of people who are from different ethnic classifications. Instead on being identified as nationalist we are trapped in a cobweb of our founding fathers making of a nation of racist.

This has resulted in the nation which is endowed with people of certain ethnic groups who have the talents and the ability to out shine and overcome any discriminatory policies that were first set in motion in the year of 1970 by the Barisan National (BN) government, as it still languishes in the pit of a bottomless sewer, where the ethnic purported Malay masses are still living in poverty.

Even in this day and age the United Malay National Organisation (UMNO) which is the dominant party in the BN is not able to face reality that it will not be able to create history as UMNO endeavours to re-write history.

UMNO is engaged in an expedition and a misadventure to erase the well enshrined and deep rooted historical facts of how this nation was discovered, colonized and developed and grossly fails to give recognition to the people that devotedly contributed to laying the foundation to making this nation to be what it is today.

Why is it so?

According to historically documented facts the term Maleyu originated from Sri Lanka. The Ramananya is described as the monkey-god referred to as the Hamunan’s that came to the rescue of King Rama’s consort known as Sita from the demon King Ravina who lived in a city of gold in an island in Sri Lanka..

This city of gold was called Malayan. It supports the evidence that Malay culture originated from the riches of India when India was rich and powerful in gold and spices.

Further it is recorded in Malay history that Langasuka was ruled by King Wongakasan. He was a descendant of King Alexandra. This would suggest that the origins of the Malays are from the lower Greek Dravidian and Indo-Aryan ancestry as the Malays are of the Australasian group. Where it is suggested that a Malay person should be looked at in 2 levels, that is in the 1st. level the Malay should be seen as a race on the stock or racial stock level and in the 2nd. Level a Malay is to be seen at the ethnic level.

To maintain our sanity over the superficial claim made by UMNO and its racially defunct leaders let us just conclude that a person can demand for recognition that he or she is “racially” a Malay but then such a person is logically creating a fiction as he or she would still not  “ethnically” be a Malay.

Why would it be so?

This is owing to the fact that “ethnic Malays live mainly in Malaysia, Indonesia, Thailand, Singapore and Brunei. This would make the Malaysian Malays demand to be recognized as a Malay race confusing when compared with other ethnic groups within the purported Malay race.

The other ethnic groups within the purported Malay race are definitely not ethnically Malays. Such as, the Javanese, Sundanese, Bataks, Minangkabaus, Acehnese, Banjarese and Bugis (examples from Indonesia), Tetum, Mambae, Tukudede, Galoli and Kemak (examples from East Timor) and Tagalogs,Cebuano, Ilocano, Bisaya, Hiligaynon and Bikol (examples from Philippines).

So the question that has to be answered by UMNO and its mediocre leaders is how are they to be “ethnically” categorized and identified when the word race is taken out of usage as we know it from our travels around the world.

When we go through immigration checks around the world all non-nationals entering a country are known as “Aliens” and these people are categorized as Caucasians, Africans, Asians, Arabs or Hispanics. The term “race” has no significance whatsoever.

So does Najib and all his band of thieves which includes the pseudo Malay known as Mahathir and the intellectually dishonest Cambridge export known as Khariy Jamaluddin (KJ) Abu Bakar  become “Aliens” when they demand that they are a Malay race?  It appears to be so.

It is apparent that by UMNO attempting to play the “Racial Card” it has fallen into the bottomless pit of being a “Race” without having any “Ethnic” roots upon which it can claim to have and behold to some form of tradition and cultural heritage, but it is premised on ethnicity and not “race.”

And this could be the root cause of all the problems faced by the Malaysian civil minded and mature populace, which has to be tolerant of the conceived and diabolically executed acts by a highly confused and defunct race willing to exist without its “Roots” that is its ethnicity which is only good for ones satisfaction and glorification and has no relevance to the acquisition of intellectual knowledge and the building of a robust and vibrant economy.

The cause for the research to pen down my thoughts arose from the unsavoury and misconceived statements issued by a Cambridge exported racist without ethnicity who had caused undue alarm to a small segment of racist in the Island of Penang over the procession that was to be held in conjunction with the birthday of Prophet Mohammad son of Abdullah son of Abdul Muttalib.

This racist states in his Blog posting and I quote:

Pergerakan Pemuda UMNO Malaysia (Pemuda UMNO) begitu terkejut dan memandang serius laporan Utusan Malaysia yang menyatakan bahawa Kerajaan Negeri Pulau Pinang di bawah kepimpinan YAB Lim Guan Eng telah membatalkan perarakan bersempena dengan sambutan Maulidur Rasul pada tahun ini. Ini kerana, sekiranya laporan itu adalah benar, pembatalan perarakan menyambut hari kelahiran Junjungan Besar Nabi Muhammad SAW, yang merupakan satu amalan tradisi bagi seluruh Umat Islam di negara ini, adalah satu penghinaan kepada agama Islam dan juga Umat Islam di Pulau Pinang.

Whilst KJ has started to make a storm in a tea spoon Lim Guan Eng has stated as reported by Malaysiakini and I quote:

“There is a small segment of people who are playing with racial sentiments. They  wrongly interpret matters. They have only one letter in hand, and this is misleading.

It is like a blind person trying to comprehend an elephant. The person is gripping only the tail of the elephant, but has concluded that what is in his hand is actually a snake,”

Since I have quoted both the statement of the Cambridge export and that of the Chief Minister of Penang it is for the reading public to draw their conclusions which should be premised on our shared values and behaviour based on our good nature as a mature community.

From an objective view it is clear and apparent that KJ is currently suffering from a great loss of self respect even though he has been elected through corrupted means to the insignificant position of the Chief of UMNO youths. No doubt at one time that position held a great deal of power in the halls of power amongst the robber barons but not anymore as their days in office are numbered.

KJ is in the eyes of the general voting populace an endangered species. We all know that he is a show man and not a “dedicated leader” as he is a racist of the highest order. He should quickly learn to stop expressing his worthless emotions which are premised to garner support on racial and religious grounds to invoke or manufacture self pity.

He should also realize that if he considers himself to be an intellectual he should not reach a conclusion based on mere gossip as that is the most dangerous school of thought as it would make KJ a pariah in the image making faculty of the mind of all right thinking and mature people.

In the final analysis it would be an insult to the intelligence of all right thinking and mature Malaysians for mediocre politicians to ever dream of corrupting the heart of the people with their racially and religiously tinted antics as their visual presentations which is premised on race is no longer seductive to our imagination.

Therefore the last thing we need is a visual reconstruction of the dark clouds of racial and religious controversies. In its place all politicians on both side of the political divide should generally play politics but in particular focus and channel their energy to see over the horizon so that they can diligently chart policies on our economic stagnation and to arrest the current loss of our competitiveness in the global arena before we slip into being a despondent state, which is indeed not an imagined threat.

SEMANTIC PARADOX OF 1 MALAYSIA CONCEPT

The Alliance Party which subsequently became the Barisan National (BN) has since our Independence on August 31st. of 1957 been and still continues to be the mother of all racist and are operating as political parties in Malaysia.

The closing balance of all its political objectives and activates are now in the hands of the United Malay National Organisation (UMNO). It is common knowledge that UMNO being a racist party of the highest order only represents the interest of the ethnic Malays who are its members. But then the ethnic Malays are split into supporting UMNO or Party Keadilan Rakyat (PKR) or the Pan-Malaysian Islamic Party (PAS).

But since March 8 of 2008 UMNO leaders and Najib, who were perpetually lazy and only thought of the Malay interest and raped the nation’s coffers by their formulated policies like the New Economic Policy (NEP) which was introduced by his father Razak and discriminated the non- ethnic Malays like the ethnic Chinese and Indians through the “concept” of Malay Supremacy, now all of a sudden want to purportedly represent all Malaysians.

UMNO’s attitude and modus operandi is more akin to the fable of Rip Van Winkle. Like Rip Van Winkle a villager of Dutch descent who lived before and after the American Revolutionary Wars in a nice village at the foot of New York’s Catskill Mountains, the UMNO men met the ghost of Henry Hudson’s crew playing nine-pins and drank some of their liquor of “Malay Supremacy” and went to sleep under the shady umbrella of BN.

Just like Rip Van Winkle the UMNO men and Najib woke up and returned to the voters after 20 or so years in March 8 of 2008 and realized that they have lost their two-third majority in parliament.

In the case of Rip Van Winkle he had proclaimed himself as a loyal subject of King George III not knowing that the American Revolution has taken place and had changed the American way of life.  Unfortunately an old local recognizes him and Rip resumed his idleness in his daughter’s home.

But in Najib’s case all those who were born before 1950 and most of us who are keen observers of politics are aware that in 1987, when Najib was the UMNO youths chief had threatened with the waiving of his kris that he would bath Kuala Lumpur with the blood of ethnic Chinese over the setting up of the Merdeka University and over some other politically sensitive issues.

Then we had a mad man who was a pseudo Malay as the Prime Minister in office for 22 years who was down right a racist but conveniently forget that when he Mahathir registered as a Medical Student in Singapore he stated he was an Indian. Najib inherited the ghost of Mahathir.

Thus the abuse and systemic marginalization of the ethnic Chinese and Indians resulted in the political tsunami that transformed the political landscape in our nation. It resulted in the making of a drastic change to the recognised “Brand” of elected members of parliament on March 8 of 2008.

Hence, the established brand of political parties within the BN such as the Malaysian Chinese Association (MCA), the Malaysian Indian Congress (MIC) and the Gerakan have almost come to the stage of facing extinction or to use a better metaphor is moribund which translates to being at the point of death.

Nevertheless, Najib who graduated from a university located around the region where Sherwood Forest is located conceived and introduced the idea of the 1 Malaysia Concept but it is not premised on the philosophy of the legend of the famous Robin Hood. But in Najib’s case he takes as he likes from the tax payers money and disburses it as he likes.

The 1 Malaysia “Concept” is a generic term which is generally used in an abstract base in the field of computer science, in the programming language. It is used to describe the support of operations on a type which include syntax and semantics and as such the concept is inapplicable to the governing of a nation where the Supreme Law of the nation is enshrined in the Federal Constitution.

As a leader, Najib is incapable of being astute and has grossly failed to use the image making faculties of his mind. The Star reports on 14.02.2010 that Najib hoped all Malaysians will look ahead with greater optimism and resolve to build a stronger and more dynamic 1Malaysia.

Najib is further quoted as saying, “that it was an opportunity for all to reflect on personal achievements, shortcomings and challenges….and resolve to become better individuals in the years ahead.”

On reading Najib’s Chinese New Year message it is apparently clear to all right thinking people that Najib is a “Hypocrite” of the highest order. In actual fact “NAJIB HAS TO RESOLVE TO BE A BETTER INDIVIDUAL” as the majority of the people of this beautiful nation of ours have at all times been civil and have always demonstrated the spirit of humanism.

Whilst Najib thinks he is the Prime Minister, we the voting populace think and we cannot be wrong until proven otherwise, that Najib and his Ministers and UMNO supporters are haughty, ignorant and arrogant.

As such Najib and UMNO must resolve in the first place, to set up an Inter-Religious or Faith Council to deliberate on issues relating to religious matters which can be amicably discussed and resolved so that Najib does not have to manufacture stupid statements when his fanatical UMNO supporters become intoxicated with hatred and threaten to carry out illegal demonstrations with the tacit approval of our highly in-disciplined high ranking police officers.

Najib and his grossly incompetent ministers who are mostly intellectually dishonest and arrogant and morally defunct or bankrupt must resolve to serve the people and protect the rights of every individual and the marginalized ethnic Malays, Indians and Chinese as they are all citizens of this beautiful nation and every effort should be made to elevate poverty and the civil servants must empathize with the sufferings of the unfortunate everywhere in this nation as though the suffering were being faced by them.

As the language of 1Malaysia is ambiguous and as it is redundant Najib should stop wasting good tax payer’s money promoting his dreams or ideas which to all right thinking people is an idea of a megalomaniac.

It is time to let go of the 1Malaysia Concept as it is in the pit of a bottomless sewer.

Channel the government’s energy to undo the damage done to this beautiful nation by a pseudo Malay who goes by the name of Mahathir. Stop the brain drain. Appoint persons based on meritocracy who are imbued with qualitative knowledge who will be able with their refined philosophy to impart their fresh growing wisdom from which the people of this nation can learn to appreciate and in return give respect.

Have the courage to replace the current educational policies, and do away with your preferential entry policies into institutions of higher learning and replace your current mediocre senior officers in all institutions as they are incapable of imparting knowledge which is capable of producing well qualified human capital to compete in the new world order of the knowledge based industries.

Therefore, Najib it is you who has to resolve to be a better leader. We are fully aware of the radical changes that are taking place in all the modern societies of the world. As such it is you who must stop playing racial politics and act with decisiveness and introduce and execute policies with speed to meet the demands of the business communities as we pay your allowances which keeps you going in your office.

If you and your government cannot be responsive then we as a business community cannot build or develop good and sound organizations. And may be that is why we are caught in a middle income trap and because of the government’s policies and poor response from the civil service we may be doomed to face stagnation in our economy.

Therefore, Najib and your henchmen should wake up or ship out.

PAKATAN RAKYAT ENDS LAWMAKERS ZEAL OF GREED

The Barisan National (BN) is the most worthless political coalition of race based parties ever to have been in existence in the political spectrum of our nation. Najib and Muhyiddin of the United Malay National Organisation (UMNO) have run out of creative ideas. They are not astute leaders and have no inclination or the capability to demonstrate to the general populace on their abilities of how they can improve the nation’s current economic depression and thus have become a liability in the eyes of all right thinking people, as they cannot continue to govern us, but pretend they are still capable.

That is why Najib and Muhyiddin are not surprised, as reported by the Star of 13.02.2010 on Zahrain Hashim’s(ZH) move to resign from Pakatan Rakyat (PR) and be an Independent Member of Parliament of the Bayan Baru constituency.

Then we have Hishammuddin an UMNO Vice President who as far as all right thinking people are aware is intellectually dishonest and is morally bankrupt as he has no adequate reserve of character and we know he is a charlatan. But now he has anointed himself to become a clairvoyant to predict the future of the PR in the Chinese Year of the Tiger.

The Star reports that Hishammuddin “believes more will be leaving PKR and Pakatan Rakyat as they are unhappy with the way the parties and coalition are being run.”

The reason ZH has been unhappy is owing to the fact that the Chief Minister of Penang strictly adheres to the principles of “Competence, Accountability and Transparency.”

Premised on this motto Lim Guan Eng (LGE) rejected a tender which was selected and submitted to the Penang Development Board (PDB). The PDB owns the Island Golf Properties Berhad (IGPB) and thus ZH is its chairman. The tender was called for managing the golf course which is valued at more than RM 40 million.

ZH incorporated a private limited company with a paid-up capital of RM 2, which is premised on UMNO’s principles of cronyism and nepotism, awarded the tender to his company. LGE as the Chief Minister rejected the approval of the awarded tender and re-called a fresh bid of the tender.

This action of LGE angered ZH and ZH went to town with the allegation that LGE has relieved ZH on  the chairmanship of IGPB where ZH has earlier called LGE to be a dictator, chauvinist and a communist-minded leader.

In the mean time some other mentally retarded members of parliament joined the band-wagon of ZH and started to issue press releases to gain cheap publicity. The main stream print media, who are known to be tigers with jelly teeth, published the news which is only fit for the dustbins of journalist views. The reports are totally devoid of the fundamental principles and conception of their roles and responsibilities of ethical news reporting.

The main stream print media faithfully targeted the PR and LGE and published statements made by the mentally retarded members of parliament such as Tan Tee Beng of Nibong Tebal of Penang, Zulkifli Noordin of Kulim Bandar Baru of Kedah and Wee Choo Keong of Wangsa Maju of Kuala Lumpur.

It is apparent that these mentally retarded elected representatives fail to realize the fact that the voting populace of today have an attitude of enlightenment on a wide spectrum of  knowledge amongst other factors which affect their daily way of life and in particular, the political, educational, health and economic affairs of our nation.

Whilst we voted for change and in the process the PR in particular the PKR seems to have selected the worst sort of idiots as candidates and as we voted for the “party”  these misfits and malevolent individuals have been elected into office. And only now are they showing that their attitudes are just like monkeys which do not know how to appreciate a bouquet of flowers.

These misfits are oblivious to the doctrine of fidelity. Neither do they understand the importance of living and enhancing the spirit of maintaining harmony as members of a political party. They are not able to comprehend as to how they are supposed to work within the framework of the party’s constitution and the surrounding policies formulated by the leadership of the PR which is for the attainment of social order and democracy, which would eventually translate into more support being given by the people to the political struggle of the PR to lead this beautiful nation in the near future.

It is high time that Anwar realize that we require him to be more decisive in dealing with these misfits or mentally retarded elected representatives. These misfits must recognize that within the PR as much as diversities and differences are bound to exist but there must be recognition given to the leaders to lead within the space and regulatory authority of their leadership parlance of office.

If any elected representative is not able to demonstrate with empathy that he supports the ideas and activities but keeps on interfering with the formulated ideas and activities of the PR, then Anwar should say good riddance to such representatives without regret. As Rome was not built in a day, we the voting populace will develop our own constraining ways to censure these radicals at the ballot box in the future.

The time has come for the voting populace to put the PR leadership on notice that in the future the leadership should only appoint persons with outstanding professional qualities and those who have a high degree of morality to be nominated as representatives of the party to contest in elections.

Further all appointed positions in every governmental institutions which include the Government Linked Corporations, the Judiciary, the Police Force and the Institutions of higher learning should only be occupied by persons with outstanding professional qualifications and qualities and a high degree of morality without regard to race, colour, creed or religion as these are positions of authority and responsibilities, or else it will lead us down the path to destruction as what BN is currently doing.

The PR should also discard the superficial label of importance given to the National Language. It should be always mindful that only education would be able to free this nation of diverse people from the diabolically conceived and indoctrinated prejudices and current prevailing ignorance in the social fabric of our nation.

As the Turks say, “Speak out, and you are persecuted; hold your tongue, and your guts boil over.”

Therefore, the PKR leaders should give recognition to the masses passion for justice in all sectors of our society.  Anwar and his team of leaders should let any radical elected representative who has a zeal for greed to leave the party as the voting populace is now more focused on Competency, Accountability and Transparency in the management of the affairs if the government rather than believing in mere blind political rhetoric.

As we see it obedience is necessary for the proper conduct of human affairs. Thus, any body of politics in which there exist individuals that are not governed by a sovereign leader,  and if such radical person is not held accountable to somebody than such party would eventually end up in the hands of a sick leader and we cannot let it happen to PKR.

HAS UTUSAN MALAYSIA COMMITTED CONTEMPT OF COURT

We claim to be a democratic society. We are guided by a written constitution. Article 10 of the Federal Constitution provides for the freedom of speech and expression with the caveat that Parliament may by law impose such restrictions as may be deemed necessary.

We as a nation of diverse people are very familiar with all forms of regulations both written and unwritten which curtails our freedom of speech and expression. Further we are all too familiar with the modus operandi of the main stream print media which is basically the propaganda machinery of the politicians in power.

Therefore, freedom of the press is premised on meeting the requirements of the Printing and Publications Act. As such the government of the day has ensured that freedom of the press is not a fundamental right under our constitution.

Nevertheless, the press has a role to play when it publishes proceedings in a criminal proceeding, especially in the case of Anwar’s Sodomy 11 trial. The press has a right to publish fair comments on matters of public interest.

However, in the case of Utusan Malaysia (UM) it has published comments that would tend to prejudice a fair trial. For starters its headline is most spectacular. It reads:

“Alasan Saiful berhenti kerja dengan majikannya, Anwar Ibrahim”

TAK RELA DILIWAT LAGI

Then in its publication it reports, “Berhenti kerana tidak mahu diliwat lagi” which on being translated would mean, “ Resigned because he did not want to be sodomised again”

Now how does the report sound to all right thinking people? Is this not scandalous? Has not Utusan Maklaysia’s publication and its statements been written in such a way where it has been calculated to prejudice a fair trial and the course of justice? Does the statement not amount to scandalizing the proceedings in court? And is the statement not a contempt in the face of the court?

On Friday last week, Anwar’s Counsel Karpal Singh brought the publication to the attention of Justice Mohamad Zabidin Md Diah. The judge failed to initiate contempt proceedings against UM. Neither did the judge having the inherent summary powers bestowed on the court, caution UM.

The inaction of the judge led Anwar’s defence lawyers to file an application in court this morning to “Disqualify the Judge” from continuing to hear Anwar’s case as the judge was biased and generally in the eyes of the general public the judge was not acting reasonably and in accordance with the oath of office that he has taken that is to “faithfully discharge my judicial duties in that office to the best of my ability, that I will bear true faith and allegiance to Malaysia, and will preserve, protect and defend its Constitution.”

The question is: is it not the duty of the judge to make it known to UM that whilst the court does recognize UM’s role to report news with fair comments on the trial, that the court will not hesitate to send the editor to prison in the event that UM were to publish such statements which are calculated to prejudice the course of justice.

If the judge had done so, he would have made it known to UM and UMNO and the public that he would not permit such sort of things to happen and that the editors of news papers would realize that the arm of the law was strong enough to reach them if they disobey a court order.

If that had only happened, the public would have saluted the judge for being impartial and in dispensing justice in accordance with the law. But now it appears that the law is not maintained in its full integrity.

The judge should be aware that no judge has power but duties to be performed to the best of their ability. If only the judge had executed his duties well then the people would say give him a chance but unfortunately he failed. He has forfeited the confidence the court of public opinion has on him. As such he will never regain the peoples respect and esteem.

Therefore if UM wants to be virtuous it must first demonstrate that it has a duty to publish fair comments on Anwar’s trial and ignore all its inclinations with UMNO. If not lying in its publications would become normal. In such an event the concept of truth and lying would disappear.

In such a situation we would be living in a nation where our language, logic and the meaning of all our communication in our daily interaction would naturally disappear into the limbo of some form of nightmarish illogical vacuum.

As Aristotle said: “Individuals must accept responsibility for their voluntary actions which involve others “ And in this light we hope that the Judge will discharge himself from continuing to hear Anwar’s  case as of 09.02.2010 or else we would only have inward disintegration in our judicial process.

IS DEVIANCE THE FINAL CURTAIN OF UMNO

Amidst the noise and the haste that we are subjected to by the print and broadcast media on the highly controversial Sodomy II trial of Anwar, it clearly appears that the rule of law is being enforced for a political purpose. Saiful is a college dropout. He claims to idolize Anwar. He was engaged as a political assistant. The oral evidence he has placed before the court under the examination in chief all the more goes against the grain of common sense or logic. It seems more of a myth. Why is it so?

The Star of 04.02.2010 carries a headline on its front page which is Captioned “Sex proposal” and goes on to report that Anwar asked Saiful point blank if he could have sex with him. The prosecution has stated that they will prove their case from the semen specimens taken from Saiful’s anus.

What seems to be amiss here is the evidence of Saiful which goes against the grain of common sense and defeats logic. In one breadth Saiful said that he was “angry and scared” and he rejected Anwar’s request. Then he states in evidence “I told him I did not want to do it.”

Then in the next breadth Saiful states that after he had said no to Anwar, he was told to go into the master bedroom, which he did. Then Anwar comes in and closes the curtains and switches off the lights and Saiful stood still. WHY?

Then Anwar asked Saiful to “clean up” in the bathroom and Saiful removed his clothes and washed up and took a towel from the bathroom and donned it. When he returned to the bedroom where Anwar was standing on the edge of the bed clad in a towel. Then Saiful said “ He directed me to go to him and then hugged me while we were standing.” The rest is heard in camera.

Now this sneak preview of the opining salvo of the prosecution’s case has given rise to a tremendous amount of criticism in the alternate media and to a larger extent these criticisms are generally constructive and thereby are highly disturbing.

In the first stage the prosecution is endeavouring to plainly paint a picture that Anwar is a Maniac. The script is not a script as depicted in court. We the right minded people look at it objectively, because in one breadth Saiful states “I rejected his request. I told him I that I did not want to do it.” Then in the next breadth Saiful states that Anwar became angry and he asked him to “clean up” and Saiful became “obedient” and went into the bathroom and cleaned up and took a towel from the washroom and donned it.

How could this situation be possible? The accusation is devoid of any merit whatsoever. We have our own daily interaction with our children or family members or staff in our office or our friends or acquaintances and from our experience we know that when we ask someone to do something they do not like, and when they say “NO” it is not possible to show our “anger” and get them to do what we desire. The result would always be in the opposite of what we expect.

It is an established fact of life that when we compel someone to do something against their will and when we get angry the other party would also get equally angry. That is why there is so much of disorder even within the nuclear family, in this modern day and age. So how then would it be with our employers, coworkers, friends and acquaintances?

No doubt the time will come for the defence to cross examine Saiful, if at all the judge decides to call for Anwar to enter his defence. At that stage Saiful would be left open to the defence lawyers to hound him.

Saiful would not have the pleasure of being on the top of things. Would he have the memory to remember all that he has given in evidence in chief? May be his biggest weakness as the truth would ultimately have to prevail and the cat may come out of the bag.

It is certain that he would have his weakness and he would demonstrate the flush on his face. He would barely be able to control his rage and at that stage Saiful would find life to be empty, lonely and unfulfilled and it would not be further from the truth that Saiful would feel lost, panicky and scared. It may hit him not in his anus but in the pit of his stomach and he may have to put things right.

As much as it is too early in the stage of the trial to predict any thing, but there are some factors that have to be rationally considered. In 2008 Anwar was 62 years of age. Saiful was 23 years of age. Anwar suffers from severe problems of the spine. Over and above that at that age almost all men face some form of impotence.

So why could Saiful not stand up against Anwar which any decent human being would do but instead Saiful allowed an almost impotent man to have allegedly sodomised him?

At this early stage of the trial this seems to be the most puzzling part of Saiful’s testimony. There is another part of Saiful’s testimony as reported in the Star on 06.02.2010 where Saiful states that he did not pass motion for two days after he was allegedly sodomised on June 26 of 2008.

This form of evidence is to be considered as an exaggeration of what nature would not permit to prevail. Just carry out an investigative report of sodomy amongst consenting adults and one would be made to realize that what Saiful is stating in evidence is incorrect and a myth. This is owing to the fact that the rectum is not like the vagina that would contain semen may be up to two days.

But in the case of the rectum it by nature dispels anything foreign without retention. You can get the confirmation from any homo or write to Elton John and he may give you an appropriate reply. It is of common knowledge that every one of us after a sexual act would wash up. But the prosecution has conveniently not raised this issue. We wonder why?

It is apparent that Saiful has been coached into the giving of the evidence. It also appears that Najib  and UMNO want to give this charge of sodomy against Anwar a great deal of sensationalism hoping that it will in the process discredit Anwar.

On the contrary the court of public opinion is much more mature that the mediocre UMNO leadership. The general voting populace see this script as a deviance and a diabolically conceived act and if all things were to be in order this could be the final curtain that has to be drawn on the demise of UMNO.

Hence the “Charge” against Anwar is only in existence in the mind of an inferior politician like Najib and therefore is not in existence in reality.

OLD HABITS DIE HARD

Since we took a leap into the New Year we are constantly bombarded and compelled to face fanaticism from all fronts of the political spectrum. Whilst we have a written constitution that stipulates our bill of rights, the government of the day has miserably failed to uphold our constitutional rights. So what sort of a government do we have?

This is indeed an interesting question and to answer it we have to look back not too far into the annals of our fabricated history. The acts and conduct of the recent past would suffice.

In February 2009 we had Najib demonstrating to the world that “might” is “right” and the forces of the unseen hand at work on  the rule of law. This resulted in the rape of the Perak State Assembly. The sitting Chief Minister was unceremoniously removed from his office by the Sultan.

There are many questions which have been left unanswered. It has to do with what are the residue powers of the Ruler of a state. One is left to wonder, as to how the Sultan who was the former Lord President of our Supreme Court, who had written many a judgments with divine prescience and perfect clarity,  could have committed such a glaring error, of removing a sitting Chief Minister.

Or had the Sultan misjudged the constitutional principle that we are a modern constitutional monarchy and that feudalism has long since gone out over the open seas. And is it not an established rule of constitutional law that a sitting Chief Minister can only be removed by a resolution moved by the floor of the Assembly.

Be that as it may, the High Court in May of 2009 granted Nizar a declaration that he is the rightful Chief Minister of the State of Perak. An appeal was immediately lodged and within 24 hours a single Judge at the Court of Appeal granted a stay order. The appeal was heard and the declaration issued by the High Court was set aside.

Nizar appealed to the Federal Court which heard the matter on the merits and a much awaited decision is to be delivered on 9 February. 2010. The question on every ones mind is would the heavens fall after the 9 of February 2010. Let us wait and see.

Then there arose the sentiment of Najib to take over the Selangor State Assembly by hook or by crook. But unfortunately the Malaysian Anti Corruption Commission (MACC) over reached the bounds of its jurisdiction and fell into the pits of dehumanization.

This resulted in the unceremonious death of a young man on 16.07.2009. He was the late Teoh Beng Hock who was to be married the next day, but faith had it that he was given a one way ticket to meet his Maker. No doubt his death would not be in vain, as the Inquest into his death is almost coming to a close.

Whilst the nation was coming to grips with the rape of Perak and the untimely death of Teoh, the government announced that from the year 2012 onwards Science and Mathematics will revert back and be taught in the National Language so as to give the rural children the opportunity to excel in their studies.

This was a feeble way of leading by example or we have charlatans in government. It only goes to demonstrate that the United Malay National Organisation (UMNO) is invisible to the fundamental connection of the basic educational requirements of a globalised and borderless world in which our children have to communicate and compete. The education policies have clearly drawn a division of connection and have now consigned or chartered  the roadmap for the destruction of creativity in education.

Then we had the New Year gift of interethnic chaos over the generic word of Allah. This led to the fire bombing of places of worship. Whilst in earlier situations, people who had carried out passive resistance over the death of democracy were put in remand. But in this situation,  Najib said that the government cannot stop people who had planned to protest against the High Court ruling that the ban issued by the government against the Catholic Church on the use of the generic term of Allah was unconstitutional.

It is indeed crystal clear that this moribund government which in the past has clearly demonstrated it will that it opposed any exercise of the people of the freedom of speech and assembly, now says it cannot stop planned protest. This smacks of institutionalizing racism to enhance the deteriorating support of the ethnic Malays for UMNO.

On the other hand after having had marginalized the ethnic Indians for 52 years and having had locked up some brave souls under the Internal Security Act (ISA) since November 2007 and subsequently releasing them based on mounting national and international pressure in 2009, Najib attempted to show the ethnic Indians on the eve of Thaipusam that he cares for the welfare of the ethnic Indians.

What Najib fails to realize is the fact that the ethnic Indians in Malaysia who have been marginalized for 52 years may be poor materially but they have their dignity and their integrity intact and further have a civilization of over, 5000 years behind then to look up too and treasure.  They can easily see through a hypocrite.

Now as of February 2 2010 we have the judicial circus of Anwar Ibrahim before the Courts. What does Najib intend to achieve is within the general contemplation of the voting populace. But will the Courts permit injustice to be the order of the day when the whole world is wired on the on goings of the trial is something to watch and behold.

As Anwar’s circus was going on in the Court another circus was taking place in Malacca where it is reported in Malaysiakini that Najib’s special officer namely Nasir Safar in the Prime Minister’s Department had stirred up a hornet’s nest. He had in his speech apparently referred to the ethnic Chinese and Indians as immigrants or guests and amongst other matters had stated that if they make extreme demands their citizenship will be revoked.

This prompted the representatives of the Malaysian Chinese Association (MCA), the Malaysian Indian Congress (MIC) and other Non-Governmental Organisations (NGO) to stage a walk-out. It is now reported that Nasir would tender his resignation.

The time has come for the government leaders as well as the few narrow-minded nationalist opposition politicians to be put on notice that they cannot act as though they are living in some form of an ancient community or a community without intellect.

They have to open up their mind and themselves to the whole world and compete on an equal footing. Affirmative action is dead but no one is compelling any body to forget their roots.

We as a people of this nation have a shared and common ideal that is to enlarge the economic cake where by mutual respect we can all reap what we sow which will provide for the foundation of our daily lives so that we can coexist in peace and harmony.

We should also eradicate our old indoctrinated habits which were developed from the old days of Mahathir a pseudo Malay who is a racist of the highest order who had the tendency to instill in the minds of the feeble ethnic Malays to look at the other ethnic groups as enemies and in consequence make them as scapegoats for the failings of their own leaders.

Let us commit ourselves to do away with the ethnic barriers put in place by UMNO, the MCA and the MIC and improve our ethnic and religious relations and work as a united people of Malaysia to expound and showcase our creativity to the world.

Let us educate our government leaders that they have a duty to uphold our constitutional rights without regard to race, colour, religion or creed. The government should cease from fragmenting the nation as we the people do know and do live with compassion and creativity in our daily interaction at our place of work.

RUN AWAY THOUGHTS OF ERRAND YOUTHS

As the days go by all the right thinking people of this nation would be amazed with the antics of Najib’s government. As a government it has the responsibility to maintain law and order without bias. The government in the first place should have upheld the constitutional rights of all the citizens, to profess and practice their religion without undue and nonsensical restrictions being enforced on how the citizens address the Supernatural Being. The government implied by its orders that the Muslims in Malaysia have a “Copy Right” over the generic term Allah.

The politicians from the United Malay National Organisation (UMNO) and a lost sheep of UMNO by the name of Zulkifli Noodin who by default is now a member of the Parti Pakatan Rakyat (PKR) and Hassan Ali of the Pan-Islamic Party (PAS) have not learned to embrace the universal values of humanity which to our commonsense would translate to there being sincerity, empathy and the easiest of all would be simplicity as being our way of life.

These politicians have become unscrupulous in expressing their ideology in respect of their faith in their religion, so much so, that it has given the general populace a great deal of anxiety over the current prevailing situation.

This is owing to the fact that over the last three weeks some Muslim youths who do not possess wisdom and or compassion have chosen to express their prejudices and misconceptions on what they have conceived from the idea of ketuanan Melayu or the indoctrination through the Biro Tata Negara by fire bombing and vandalizing the places of worship of Christians and Sikhs.

As much as the UMNO politicians have not learned to improve their psychological well being they are now demonstrating to the world that they are not capable of improving their mental wellness as they have all along been intellectually dishonest.

Since they have no comprehension of what empathy and mutual understanding means in a diverse society, as it is not in their vocabulary, they have to carry out a crusade to showcase to the world that they cannot surrender their implied copy right on the generic term of Allah.

Whilst their antics of fire bombing and vandalizing  places of worship have been largely ignored be the Christians and the Silks, where in fact we have stated that we forgive them for they know not what they were doing, these errand youth decided to change their modus operandi, to create civil strife.

The errand youths or their puppetry miscalculated their acts. They decided to burn the place of worship of Muslims hoping to generate anger amongst the ethnic Malay masses. We are currently living in the 21st. Century where all politicians from both sides of the political divide have to seriously take into consideration  the complexities of  globalization and further the dynamism of our multicultural society.

The ethnic Malay by themselves will get lost in not being able to navigate the labyrinth of the technological innovations that are taking place in the universe and more so with the education policies being that the children would have to be educated in the National Language.

Even now we have a large pool of highly qualified persons who are not comfortable in communicating and writing in the English language and are thus unemployable. Therefore it is only proper that the politicians from both sides of the political divide should stop playing and propagandizing and creating imagined communities. Their political acts will only lead the future generation of the nation to the tabernacle of misfortune and impoverishment.

As Friedrich Nietzsche said: “One must separate from anything that forces one to repeat no again and again” And we all know that in this day and age we as a nation which survives on exporting our goods cannot afford to progress in isolation on the premise of Ketuanan Malayu and say no to Foreign Direct Investment as we do not have much developed indigenous technologies to create employment opportunities.

This is extremely bad for foreign investment in the our country and now we wonder how many big foreign companies are going to start pulling out in the next few months or so. The time has come for the government of Najib to realize that Malay Supremacy has long since been redundant as Mahathir burnt his fingers by toying with that pseudo ideology.
